Agreement to These Terms

These Terms & Conditions (“Terms”) apply to your purchase, access to, or participation in offerings operated by Cartagena Consulting LLC (“Company,” “we,” “us,” or “our”), including programs offered under The Magnetic Effect brand.

By purchasing or participating in a program, you acknowledge that you have read, understood, and agreed to these Terms.

The Magnetic Effect Founding Cohort

The Magnetic Effect Founding Cohort is an 8-week live coaching, education, and integration experience designed to help participants understand, practice, and integrate the principles taught through The Magnetic Effect.

The core live component currently includes:

• One live Zoom group coaching and integration call per week for eight weeks.
• Coaching, discussion, feedback, questions, and practical integration during those sessions.
• Real-world exercises, practices, or “Magnetic Missions” that may be assigned during the program.
• Reasonable opportunities for questions or support between sessions through email and/or another communication channel designated by the Company.

Because this is a founding cohort, the exact format, supporting materials, exercises, lesson structure, and delivery details may evolve as the program is developed and refined.

Any such adjustments will be made in good faith and will not intentionally eliminate the material live-program experience described above.

Program Start Date & Scheduling

The starting date, regular meeting schedule, Zoom access details, and other logistical information will be communicated to founding members after enrollment.

Participants are responsible for reviewing program communications and making reasonable efforts to attend scheduled sessions.

We reserve the right to reasonably modify dates, times, or scheduling when circumstances require it.

If a scheduled session must be canceled or rescheduled by us, reasonable efforts will be made to reschedule or otherwise provide the applicable program component so participants receive the material live-program experience included with their enrollment.

Missed Sessions

Participants are responsible for attending scheduled live sessions. Missing a session does not create an entitlement to a refund, partial refund, program extension, private replacement session, or individual make-up coaching.

When recordings or other materials are available, they may provide an opportunity to review a missed session, but availability of a recording is not guaranteed for every session unless expressly stated otherwise in writing.

Session Recordings

Live group sessions may be recorded for program-delivery, educational, archival, or participant-access purposes.

By voluntarily participating in a recorded session, you acknowledge that your name, voice, image, comments, questions, or other contributions may be captured in the recording and may be made available to other authorized participants in the applicable program.

When recordings are provided, access may be available for a limited period. Purchase of the program does not include a promise of permanent or lifetime access to session recordings.

Between-Session Support

Participants may receive reasonable opportunities for questions and support between live sessions through email and/or another communication channel designated by the Company.

Between-session support does not include or guarantee:

• 24/7 availability;
• Immediate responses;
• Unlimited private coaching;
• Unlimited text or direct-message access; or
• A specific response time unless expressly stated in writing.

Communication methods may be adjusted during the program when reasonably necessary to maintain appropriate boundaries and effective delivery.

Bonus AI Tools & Digital Resources

The Company may make AI-based tools, GPTs, worksheets, recordings, exercises, prompts, or other digital resources available as supplemental bonuses.

Unless expressly sold as a guaranteed core component of the program, bonus resources may be modified, replaced, updated, restricted, or discontinued at the Company’s discretion.

Access to an AI tool or other bonus does not create a guarantee of permanent or lifetime availability.

Confidentiality & Participant Privacy

Group coaching depends on participants being able to speak openly. Participants therefore agree to respect the privacy and confidentiality of other participants.

You may not record, reproduce, publish, distribute, share, or publicly disclose another participant’s personal story, identity, comments, experiences, or confidential information without that participant’s permission.

Participants may discuss their own personal experience and learning, provided they do not reveal confidential or identifying information about other participants.

Intellectual Property

Program materials, frameworks, exercises, written materials, recordings, lessons, prompts, branding, and other proprietary content supplied by the Company are protected intellectual property.

Your enrollment provides a personal, limited, non-transferable right to use program materials for your own participation and personal development.

You may not reproduce, sell, distribute, republish, teach, sublicense, upload, or commercially exploit program materials without prior written permission.

Payment & Final-Sale Policy

Unless a different policy is expressly stated at checkout, purchases of The Magnetic Effect Founding Cohort are final and non-refundable once enrollment has been completed.

Missing sessions, choosing not to participate, failing to complete exercises, changing your mind, or failing to use available program resources does not create an entitlement to a refund.

Nothing in these Terms is intended to waive or limit any non-waivable rights or remedies you may have under applicable law.

Payment Disputes & Chargebacks

If you believe a billing error has occurred or have a legitimate concern regarding your purchase, please contact us first so we have an opportunity to investigate and address the issue.

We reserve the right to provide relevant purchase records, acceptance of these Terms, access records, communications, and other appropriate documentation in response to payment disputes or chargebacks.

Fraudulent or knowingly false payment disputes may result in termination of access to Company programs and services.

Participant Conduct

Participants are expected to interact respectfully with the Company, the instructor, and other participants.

We reserve the right to restrict or terminate participation for:

• Harassment, threats, or abusive conduct;
• Repeated disruptive behavior;
• Violation of another participant’s privacy;
• Unauthorized sharing of program materials;
• Material violations of these Terms; or
• Conduct that reasonably interferes with delivery of the program.

Removal for material misconduct does not automatically create an entitlement to a refund, subject to applicable law.

Educational & Coaching Disclaimer

The Magnetic Effect provides coaching and educational content for personal development purposes.

The program is not medical care, mental-health treatment, psychotherapy, legal advice, financial advice, or a substitute for services from an appropriately licensed professional.

Participants remain responsible for their own decisions, conduct, relationships, communications, safety, and wellbeing.

No Guarantees of Results

The Company does not guarantee any particular dating, relationship, attraction, confidence, social, personal, financial, or other outcome.

Coaching can provide frameworks, feedback, education, exercises, perspective, and opportunities for practice. Individual results vary and depend on factors outside the Company’s control, including each participant’s circumstances, choices, consistency, implementation, behavior, and interactions with other people.

No statement on the website, in the masterclass, during coaching, or in program materials should be interpreted as a promise that another person will respond, feel, behave, date, or enter into a relationship in any particular way.

Changes to the Founding Program

Because this is a founding cohort, the Company may reasonably refine program structure, supporting materials, exercises, communication methods, bonus resources, and implementation details based on participant needs and experience.

These adjustments are part of the founding nature of the program and will be made in good faith without intentionally eliminating the core live coaching and integration experience represented at the time of purchase.

Governing Law

These Terms will be governed by and construed in accordance with the laws applicable to Cartagena Consulting LLC, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Business Information

The Magnetic Effect is operated by Cartagena Consulting LLC, a limited liability company registered in the United States.

References to “The Magnetic Effect” throughout this website and these Terms refer to the brand and offerings operated by Cartagena Consulting LLC unless otherwise stated.
